Alexandria Swette is a seasoned trial lawyer who represents institutional clients and their executives in high-stakes commercial disputes, cross-border investigations, and government enforcement actions. Her practice spans complex deal litigation, shareholder and partnership disputes, breach of fiduciary duty claims, and securities litigation. She also defends corporations and individuals in regulatory and criminal matters involving allegations of fraud and other misconduct, with substantial experience before the U.S. Department of Justice (DOJ), the Securities and Exchange Commission (SEC), and the Federal Trade Commission (FTC). Her expertise covers a wide range of industries, with particular focus on data analytics, digital marketing, FinTech, EdTech, HealthTech, social media, and emerging technologies.

Ms. Swette is a persuasive and effective courtroom advocate, and she has a strong record of favorable outcomes. What sets Ms. Swette apart is her ability to quickly grasp complex subject matter and translate it into clear, compelling narratives for judges and juries. Her clients value the confidence she brings to each case and her mastery of the facts. Outside of the courtroom, Ms. Swette has successfully resolved numerous matters discreetly by persuading government authorities not to bring or to drop charges. She also has achieved landmark settlements prior to trial.

Before joining Kobre & Kim, Ms. Swette practiced at Weil, Gotshal & Manges LLP, where she focused on securities class actions, internal investigations, and white-collar defense. She began her legal career as a law clerk to the Honorable Francisco A. Besosa of the U.S. District Court for the District of Puerto Rico.

  • Representation of a former executive of fintech startup Frank in a highly publicized six-week criminal trial in the Southern District of New York following an investigation by the DOJ and SEC over alleged misrepresentations made in connection with the company’s acquisition by JPMorgan Chase.

Special Situations Disputes

  • Representation of Twitter, Inc. with respect to its high-profile, expedited Delaware litigation against Elon Musk seeking to enforce Musk’s contract to close the US $44 billion transaction. Acting as conflicts counsel, Kobre & Kim, among other things, handled the offensive discovery against Musk’s financial advisor, Morgan Stanley & Co., and the 12 banks that agreed to finance Musk’s acquisition.
  • Representation of Intercontinental Exchange, Inc., the United States’ largest provider of home mortgage loan origination systems, in handling certain offensive discovery with respect to the FTC’s challenge of its proposed acquisition of Black Knight, Inc.
