Naomi Yang on How Korean Companies Can Strategically Navigate U.S. Litigation for Korea Legal Times

Kobre & Kim’s Naomi Yang, who leads the firm’s cross-border litigation efforts from Seoul, was recently featured in Korea Legal Times. In the interview, Ms. Yang discusses how growing cooperation between the U.S. and South Korea may result in increased cross-border disputes and heighten exposure to U.S. government investigations—and how taking strategic, proactive steps early on can significantly influence how those matters unfold for Korean counterparties.

“In the case of a U.S. government investigation, it is important to respond quickly and effectively from the beginning, as the response to the initial inquiry can act as a key factor in determining the direction of the entire investigation,” Ms. Yang said in the interview.

Ms. Yang also highlights the use of U.S litigation as a powerful tool for potential plaintiffs dealing with competitors, drawing from her work on major firm matters, including the firm’s recent victory in the Propel Fuels case—one of the largest trade secret judgments in U.S. history—demonstrating the firm’s ability to litigate complex cases and deliver impactful outcomes.

Ms. Yang added, “As many Korean companies are already demonstrating mature and sophisticated leadership in the global market and becoming accustomed to international disputes, we expect that awareness of the strategic use of these legal tools will further increase in the future.”
